General terms and conditions of business

1. Scope

These General Terms and Conditions (GTC) apply to all services at the Stickler Boat Driving School / boatfahrerlernen-berlin. Courses and services are carried out exclusively under the following conditions. All oral agreements and declarations only become part of the contract if they have been agreed in writing or confirmed by us in writing.


2. Contractual partner

The service contract is concluded with the following service provider:

3. Offer and conclusion of contract

The service provider offers courses as well as individual driving lessons and training units in the areas of sailing and motorboats.

From the moment a contract is concluded, customers are bound to the terms and conditions in the contract.


4. Revocation 4.1 According to Section 312g No. 9 BGB and Section 312g No. 1 BGB, there is no possibility of revocation either with regard to our services or with the sale of our vouchers.


4.2 If the participant does not complete a course or fails/fails to register for the exam, there is no possibility of revoking the service or refunding the course fee.



5. WithdrawalThe participant can withdraw free of charge up to 7 days before the start of the course. From 6 to 2 days before the start of the course, a sum of 40% is due and less than 24 hours before the start of the course, 100% of the total price is due if no replacement participant can be found with the same conditions.

6. Prices

All prices are final prices including VAT.


7. Payment

The agreed course price is paid in cash or by bank transfer. This must be paid by the course participant by bank transfer or in cash by the first appointment. Otherwise, the course may be paused or canceled by the service provider. The decisive factor for the transfer is that it is credited to the service provider's account, at the latest on the day the course begins.


8. Sailing courses

The course fee includes all necessary practical appointments up to the SBF exam readiness. A minimum of 6 appointments for the participant, unless fewer are requested. A maximum of 15 appointments. Also practice dates as preparation in the event of a repeat exam. Materials for theory are not included.


A sailing practice appointment usually lasts 2.5 to 3 hours. Shorter appointments due to a lack of time on the part of the course participant do not result in make-up time on another date. The service provider reserves the right to reject sailing dates of less than 2 hours as the effort required (getting to the ship and clearing it) is not proportionate. All appointments must be agreed with the service provider.


9. Motorboat courses

The course price includes the necessary practical training sessions to pass the SBF motorboat test. A minimum of 3 appointments, a maximum of 12 appointments. Also practice dates as preparation in the event of a repeat exam. Theory course and materials are not included.


An engine practice appointment usually lasts 1 to 1.5 hours. Shorter appointments due to a lack of time on the part of the course participant do not result in make-up time on another date. The service provider reserves the right to reject motor appointments of less than 1 hour as the effort required (making the journey and ship clear) is not proportionate. All appointments must be agreed with the service provider.


10. Theory courses

The course price includes the theory dates specified in the course description. An appointment lasts approximately 2.5 hours. Theory learning materials such as a theory book are not included.


All appointments must be arranged with the service provider. If the course participant is unable to attend a course, the service provider must be informed in advance.


The theory sessions take place either in face-to-face lessons in a room or on a boat. In the event of government COVID19 restrictions, the courses can also be offered online by the service provider via Zoom or similar.


11. Appointment shortening

Shortening or cancellation due to bad weather such as thunderstorms, heavy rain, storms or squalls or calms or due to a lack of time on the part of the service provider gives the course participant the right to make up the course time on another date free of charge, if possible before the exam and weather permitting.


12. Cancellation of appointments and liability

12.1 The service provider is not liable for daily or longer cancellations of appointments caused by long periods of bad weather, calm periods, damage to the training boat or flooding and closure of the jetty (by the landlord). This also applies to loss of use caused by environmental disasters, wars, epidemics and government orders and laws. The course can then be continued at the earliest possible date without additional payments.


12.2 The service provider is not liable for missed appointments and their financial consequences that are the fault of the course participant and if as a result there are no longer enough appointments available to prepare for the registered exam. The service provider can provide alternative dates, but if this is no longer possible due to the exam date or the end of the season, or if this cannot be noticed by the course participant, the course participant bears all consequences.


12.3

There will be no sailing practice appointments between November 1st and May 1st, as safe lessons are not possible due to the weather and water temperature.

There will be no motorboat practice appointments between December 1st and April 15th, as safe lessons are not possible due to the weather and water temperature.


13. Official SBF examination

13.1 The course participant is obliged to register for an exam for the SBF upon the recommendation of the service provider. The appointment must be agreed with the service provider so that they can be on site with the training boat. The service provider is not liable in the event of a failure of the training boat on the day of the test. In this case, the service provider attempts to provide an equivalent boat on the agreed inspection date; there is no entitlement.

13.2 The service provider cannot guarantee or influence the passing of the SBF examination by the external examination committee. He is not liable for repeat fees. If the course participant fails, they have the right to free practice sessions in preparation for the repeat exam. The practice dates are included in the course price.

 

13.3 The service provider is not liable if the course participant fails to register for the SBF exam on time or does not submit his documents or does not pay his exam fee. The course participant is responsible for this and must clarify these matters independently with the examination board.

 

14. No-show

If the course participant fails to show up for an agreed exercise appointment three times, without a cancellation at least 3 hours before the start of the appointment, a fee of €30 will be charged for the service provider's journey. The course will only continue after payment of this fee.

 

15. House rules

The participant agrees to stay on the property of the ATV Arminia Cheruscia eV, sanitary room and the jetty only for the purpose of entering and leaving the boat and to use the paths prescribed for this purpose (yellow path). Other areas of the property and house may not be entered. Lingering on the jetty, sanitary rooms and property is not permitted. Swimming on the jetty or bank of the ATV property is prohibited, as is using or entering the floating dock for the rowing boats.


16. Termination by the service provider

The service provider is entitled to terminate the contract if there are unforeseeable circumstances, such as force majeure (e.g. strong winds, lightning strikes, hailstorms or other unforeseeable extraordinary events), destruction of the boats due to collisions, war, theft or vandalism, in the event of official bans Orders from the federal government that mean that the planned service cannot be carried out as usual in previous business operations. In this case, the customer will receive a refund for the services not provided in proportion to the total price. There are no further claims for compensation.


17. Valuables

The service provider is not liable for the safety of private items (watches, glasses, cameras, cell phones, etc.) that are taken on board the training ships or to the training area and jetty.


18. Final provisions

The customer expressly accepts the contractual conditions of the service provider with his signature. The place of performance of this contract and the place of jurisdiction for Bootsfahrschule Stickler is Berlin; the statutory provisions apply. Only German law applies. The place of jurisdiction for persons who have their residence or residence abroad or whose residence or residence is not known at the time a lawsuit is filed is Berlin. The contract is valid if the course participant has a signed copy of the contract. If a provision of this contract is invalid, the remaining provisions apply. Verbal agreements require written confirmation. Explanations and information are provided to the best of our knowledge, but without guarantee.
